Judicial system plays
vital role to eradicate social vils: Justice Nawaz

RAWALPINDI: Justice Muhammad Nawaz Abbasi, a
senior Judge Supreme Court of Pakistan on Monday
said that the judicial system in a country plays
a paramount role to advance cause of justice
and eradicate the evils from the society.
Speaking on the inauguration ceremony of 34th
four-week pre-service training course for Civil
Judges-cum- Judicial Magistrates from NWFP he
said that the lower judiciary is the backbone
of the legal system and the members of the lower
judiciary always play a vital role for the welfare
and betterment of the people through administration
of justice. He said that the concept of independence
of judiciary is not confined only to the person
of judicial officers but in the general perception
of the people, the independence of judiciary
relates to the personal conduct of judicial
officers at all levels. The manner of exercise
of jurisdiction also affects the independence
of judiciary and thus the judicial powers must
be exercise with care and restraint, he added.
“Courts must not encroach upon the area
of their jurisdiction and must keep pace from
executive to maintain their independence and
avoid any conflict” he opined.
He said that judicial profession is a sacred
duty rather a sacred mission to provide justice.
“Do your duty and impart justice without
fear or favor. Do not accept any extraneous
pressure”. He advised the young trainee
judicial officers to behave politely with the
litigants who are dragged into litigation. Your
conduct is more important for building the image
of the entire judiciary, he added. He pointed
out that sometimes Judges over-stop the limits
of their authority or commit social transgressions
which may bring their action within the mischief
of judicial misconduct; therefore, Judges are
required to be extra careful about their conduct
in the Court and outside the Court.
“Delay in writing judgments and unnecessary
adjournments are the main reasons of delay in
disposal of cases within reasonable time which
must be avoided through personal efforts, he
said. Speaking on the scope and importance of
establishment of Federal Judicial Academy he
said that there was no proper system of imparting
pre-service training to the newly appointed
judicial officers in Pakistan and they had to
perform their functions from the first day of
their appointment but now this Academy, in the
form of an institution, is providing training
to the newly appointed judicial officers under
the able guidance of Hon’ble Chief Justice
of Pakistan and the Judges of superior Courts.
It has always been the endeavor of this Academy
to ensure that participants must receive training
in all the spheres of judicial system and to
make sure that on completion of training, they
must behave and conduct with honor and dignity,
he said. Presenting his welcome speech and brief
of the course Mr. Moazzam Hayat Director General
of the Academy said that the Academy would impress
upon the participants to observe Judicial Ethics
hence he has planned to contribute on this subject.
He also impressed upon the participants to ensure
that unnecessary adjournments are not granted
and all the cases, Especially Family Cases are
expedited. Thirty Civil Judges-cum-Judicial
Magistrates including seven females participated
the four-week pre-service training course at
the FJA.
